1. Application of Terms & Conditions: This document contains the terms and conditions of entry (Terms & Conditions) into the Richmond Football Club’s “Shakeme 2024 Experience” promotion (Promotion). Other published information on how to enter, advertising material and prize information published by the Promoter form part of these Terms & Co  Entry into the Promotions constitutes acceptance of these Terms & Conditions by the individual (entrant / you).  
2. Promoter: The Promotion is conducted by Richmond Football Club Ltd ABN 25 679 793 340 of Punt Road Oval, Richmond, Victoria 3121 (Premises); Phone: (03) 9426 4400 (Promoter / RFC).  
3. Promotional Period: The Promotion commences at 00AM AEST 12/02/2024 and ends at 11.59PM AEST 25/02/2024 (Promotional Period).
4. Nature of Promotion: the entrant must commit to purchasing any 2024 RFC AFL Membership (RFC Membership) during the Promotional Period in order to be eligible to be in the draw to win the major prize of an ‘exclusive match day experience’ (described in clause below) (Major Prize).
5. Receipt of entries: All entries must be received by the Promoter by the end of the Promotional Period. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission.  Incomplete, inaudible, indecipherable or incomprehensible entries will be deemed invalid.

ELIGIBILITY

6. Eligibility: To be eligible for entry, entrants must:

• be residents of Victoria, Australia;
• be 18 years and older at the time of entry;
• NOT be an existing 2024 RFC member of any RFC Membership at the time of entry into the Promotion.

7. Exclusions: The Promoter’s directors, officers, employees of the Promoter and their immediate family members cannot enter the Promotion.
8. Verification: The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including the entrant’s identity and place of residence). Suitable proof of identification, residency and entry is at the discretion of the Promoter.  
9. Disqualification: The Promoter reserves the right in its sole discretion to reject an entry and/or disqualify any entrant who it has reason to believe has breached any of these Terms & Conditions, or engaged in any improper or unlawful misconduct that may jeopardise the fair and proper conduct of the Promotion (eg tampered with the entry process).  The Promoter's legal rights to recover damages or other compensation from any offender(s) are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

ENTRY

10. How to enter: To enter each Promotion, entrants:

• must purchase any RFC Membership after accessing through the Shakeme advertisement on the LiSTNR application (located via https://www.listnr.com/ or the App store); and
• upon entering their details, under the question 'What brings you to buying a 2024 membership?', select 'Shakeme advertisment' to be included in the draw for the Major Prize.

PRIZE & PRIZE DRAWS

11. Prize(s): The Major Prize is an exclusive match day experience which will be at a mutually agreed game during the 2024 Home & Away Toyota AFL Premiership season (AFL Game), and will consist of:

• two spots within the “Guard of Honour” pre-game; and
• two reserved seat tickets to the AFL Game and access to the Club XIII function space.

12. Prize value: The total prize pool is $140.
13. Prize draw: The winner will be determined the Promoter by using a random integer generator. The draw will take place the Promoter’s Premises at 12pm AEST on26/02/2024].
14. Notification of winner: The winner will be notified by telephone and email (using the contact details given in their entry) on within 14 days of the Major Prize draw.
15. Publication of winner: The name of winner will be published on the Promoter’s website: richmondfc.com.au on within 14 days of the Major Prize draw.
16. Unclaimed Prize(s): Despite every reasonable effort taken by the Promoter to contact the winner, if the Major Prize remains unclaimed by 12/03/2024 / 12pm AEST, then:

• the Major Prize will be forfeited by that winner;
• the Promoter will publish the fact of the unclaimed Prize on the Promoter’s website; and
• the Promoter may conduct a re-draw in order to distribute the Major Prize at Promoter’s Premises at 1pm AEST on 12/03/2024 / 1pm. The winner in the unclaimed prize draw will be notified by telephone and email (using the contact details given in their entry) and their details published on the Promoter’s website: richmondfc.com.au within 7 days of the unclaimed Major Prize draw.

17. Final decision: The Promotion is a game of chance. The Promoter’s decision for the Major Prize in the Promotion is final and binding and no correspondence will be entered into.
18. Substitution of Prize: In the event that the Major Prize (or part of the Major Prize) is unavailable, the Promoter reserves the right to substitute the Major Prize (or part of the Major Prize) in its discretion with an alternative prize (or part of the prize) to similar monetary value, subject to any written directions given by government gaming departments.
19. Additional costs: The Major Prize do not include transport, accommodation, travel insurance, visas, spending money, food and beverage costs and other ancillary costs associated with redeeming the Major Prize. These are the responsibility of the winner(s).
20. Non-transferable: The Major Prize must be taken as offered. The Major Prize, or any unused portion of the Major Prize, are not transferable or exchangeable or redeemable for cash. The Major Prize is not valid in conjunction with any other offer.
21. Prize value: The Major Prize value is in Australian dollars and is the recommended retail value as provided by the supplier and are correct at time of publication. The Promoter accepts no responsibility for any variation in the value of the Major Prize.
22. Tax liabilities: The winner is advised that tax implications may arise from their prize winnings, and they should seek independent financial advice prior to acceptance of their prize. 
23. Additional conditions: It is a condition of accepting the Major Prize that the winner must comply with all the conditions of use of the Major Prize and the Major Prize supplier’s requirements.  Redemption and use of the tickets to the AFL Game Prize will be subject to the terms and conditions stipulated on the tickets by the service provider. The Promoter will not be liable for any tickets that have been lost, stolen, forged, damaged or tampered with in any way;
24. Consent & Release Form: If the Major Prize involves the winner participating in physical activity (such as the Guard of Honour), then to participate in the activity the winner agrees to sign consent and release of liability form releasing the Promoter and its directors, officers, staff, contractors or agents from all and any responsibility or liability for injuries, losses, damages, claims, actions, costs, expenses or other liabilities whatsoever suffered or incurred by the winner arising out of their participation in the activity (except for any liability that cannot be excluded by law in which case that liability is limited to the minimum allowable by law).

RFC MEMBERSHIP TERMS & CONDITIONS

25. RFC Membership T&CS: By entering into this Promotion and as a RFC member pursuant to the RFC Membership, entrants acknowledge and agree that they will be bound by the RFC Membership Terms & Conditions at https://am.ticketmaster.com/richmond/termsandconditions.

LIMITATION OF LIABILITY

26. Lost entries: The Promoter accepts no responsibility or liability for any late, lost or misdirected entries.
27. Internet costs: Any cost associated with accessing the Promoter’s website or any other promotional website or social media platform is the entrant’s responsibility and is dependent on the Internet service provider used.
28. Limitation of liability:

• To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion, including the Major Prize.
• Except for any liability which cannot be excluded by law (in which case liability is limited to the minimum permitted by law), the Promoter, its officers, employees and agents will not be liable for any loss (whether direct, indirect, special or consequential loss), damage, claim, injury, cost or expense, which is suffered or incurred by any individual in connection with the Promotion or the awarding or use of the Major Prize (Loss), including but not limited to:
  • (i) any technical difficulties or equipment malfunction of any communication or internet system which are beyond the Promoter’s reasonable control;
  • (ii) any theft, unauthorised access or third party interference which are beyond the Promoter’s reasonable control;
  • (iii) any entry or Major Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  • (iv) any variation in Major Prize value to that stated in these Terms and Conditions;
  • (v) any tax liability incurred by any winner;
  • (vi) any participation or use of any Major Prize;
  • (vii) any Loss caused by, or contributed to, by the entrant’s breach of these Terms & Conditions or negligence; and/or
  • (viii) any liability for personal injury or death suffered or sustained in connection with the Promotion.
• Nothing in these conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.

29. Force majeure: If this Promotion is interfered with in any way, or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to:

• war, terrorism, state of emergency or disaster;
• acts of God including fire, lightning, earthquake, explosions, flood, subsidence or other natural disaster;
• war, insurrection, civil disorder, military operations or acts of terrorism;
• strikes, lock outs, bans or industrial disputes of any kind (not related solely to the party affected);
• epidemics, pandemics biological contamination or public health emergency or any resulting governmental action including mandatory business or workplace closures, work stoppages, full or partial lockdown, quarantines, border closures and travel restrictions;
• acts, directives, orders, laws or regulations of any government or government agency or authority;
• computer disruption due to the effects of a virus or other malicious code or equipment malfunction which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion; or
• the modification, suspension or termination of the 2024 AFL Premiership Season,

the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and  subject to any written directions from a regulatory authority, to modify, suspend or cancel the Promotion, as appropriate.

PRIVACY COLLECTION STATEMENT

30. Protecting Personal Information: The Promoter is committed to protecting the privacy of the entrants’ personal information.
    
    
31. Type of Personal Information: During the entry process, entrants provide information that identifies them such as name, gender, mobile telephone number, email address, date of birth and mailing address (Personal Information).
    
    
32. Use of Personal Information: By entering this Promotion, entrants consent to the Promoter’s use of their Personal Information provided for the following purposes:

(a) processing the entrant’s entry and the RFC Membership;

(b) communicating with the entrants about the Promotion and the RFC Membership;

(c) operating the Promotion; and

(d) determining and awarding the Major Prize.

(Purposes)

33. Disclosure of Personal Information: The Promoter may disclose such Personal Information to third parties, including but not limited to related entities, agents, contractors, service providers and the Major Prize suppliers for those Purposes, unless the Promoter is otherwise advised.  The Promoter requires such third parties to comply with Australian privacy laws that apply to the entrants’ Personal Information. The prize winner’s Personal Information may be disclosed to State and Territory, regulatory authorities, including lottery departments as required by law.   
    
    
34. Failure to provide Personal Information: If an entrant does not provide the requested Personal Information, then this may prevent the registration of the entrant in the Promotion.
    
    
35. Marketing: By entering this Promotion and as a RFC member of the relevant RFC Membership, entrants also consent to the Promoter using the Personal Information for promotional, marketing and publicity purposes of the Promoter including communicating with entrants about the Promoter’s future competitions, offers or event news (in any form of media, including sending electronic messages or telephoning the entrant), unless entrants opt out of receiving such communications by either:

• (i) clicking on the unsubscribe link provided in the communication; or
• (ii) contacting the Promoter’s Privacy Officer at officer@richmondfc.com.au ; or
• (iii) via your online account at https://am.ticketmaster.com/richmond/#/.

36. Privacy Policy: The RFC Privacy Policy, available at www.richmondfc.com.au/privacy, contains further details regarding how the Promoter uses and handles personal information including how entrants can access or correct information held about them; how they can make a privacy related complaint; how that complaint will be dealt with; and the extent to which the entrants’ information may be disclosed to overseas recipients (if any).
    
    
37. Consent to use details of winner: By entering this Promotion, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without any remuneration for the purpose of promoting future similar promotions and any products or services of the Promoter.
    
    
38. No endorsement by social media platforms: This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social media platform. Entrants provide their information to the Promoter.
